Vince Sicari, 'Joking Judge,' Takes Appeal To New Jersey Supreme Court

-- A judge in New Jersey is asking the state's highest court to have a sense of humor.

Attorneys for Vince A. Sicari plan to argue in front of the New Jersey Supreme Court on Tuesday that the part-time municipal court judge should be allowed to keep his other paying gig as a comedian.

Sicari is appealing a 2008 state ethics committee ruling that he can't continue working as a paid entertainer while on the bench.

Sicari, who performs under the name Vince August, said in court filings he has always kept his identity as a South Hackensack municipal court judge separate, and "there is never mention in either profession of the other."

He insists in court papers that he never even makes lawyer jokes or anything that could tarnish the profession. He claims much of his comedy is derived from non-work related personal observations, such as his upbringing as an Italian Catholic.

The Committee on Extra-Judicial Activities in 2010 reaffirmed its decision that he could not continue as a paid performer/entertainer.

Committee members said they were concerned that the "content of his comedy routine could give rise to an appearance of bias, partiality or impropriety or otherwise negatively affect the dignity of the judiciary," according to court papers.

Sicari countered that he should be able to supplement his $13,000 a year income as a part-time judge "while actively engaged in an entertainment career which provides me a substantial portion of my income."

He says he's made hundreds of stand-up comedy appearances a year, including at a New York City comedy club where he has performed since 1997, on network television, as a warm-up for Comedy Central audiences and in film. He's a member of the Screen Actors Guild and other professional performers unions.

The committee cites rules that judges may hold outside positions including gigs as musicians, as long as they don't get paid, or play at casinos, political events or in scenarios that could present a conflict of interest. They also cite a prior ruling that determined "a municipal court judge may not appear in a TV commercial for Shredded Wheat."

Sicari argues in his appeal that he takes both his entertainment and his legal job seriously.

"This issue is about a person who affects lives in many ways in two distinct identities," he said in a court filing.

HP launches Slate 7 Android tablet with Beats Audio for $169

The HP Slate 7 is beyond fashionably late to the Android tablet party, but it tries to make up for its tardiness with a very low price. When the device arrives in April, HP?s first Google-powered tablet just announced at this year?s Mobile World Congress will cost just $169. That?s $30 less than the the Nexus 7 and Amazon Kindle Fire HD. So how does this value-priced device stand out? HP is playing up the Slate 7?s Beats Audio sound and wireless printing capabilities.

The Slate 7 certainly doesn?t look like a $169 tablet, thanks to its stainless steel frame and soft-touch back that?s available in gray or red. The device measures .42 inches thick (about the same as the Kindle Fire HD?s .41 inches) and weighs 13.05 ounces, making this tablet lighter than the Fire (13.9 ounces) but heavier than the Nexus 7 (12 ounces). The Slate 7 has a microSD card slot and microUSB port.

To differentiate its tablet, the Slate 7 is the first with Beats Audio built in, which is designed to deliver richer and more robust sound. According to Alberto Torres, HP?s senior vice president of its Mobility Global Business Unit, Beats really kicks in when you?re using headphones. However, the Slate 7 does sport stereo speakers. As you might expect from HP, the Slate 7 has wireless printing capabilities via ePrint. The app lets you print from most applications.

The Slate 7 does skimp on some specs for its low price. For starters, the 1024 x 600-pixel display has a lower resolution than the Kindle Fire HD and Nexus 7 (both 1280 x 800). On the other hand, HP says its High-aperture-ratio Field Fringe Switching (HFFS) technology gives its panel wide viewing angles, whether you?re viewing documents or playing Angry Birds Space.

Powering this Android 4.1 Jelly Bean tablet is a 1.6-GHz ARM A9 dual-core processor and 1GB of RAM, and you?ll find 8GB of storage on board. The Slate 7 features a VGA camera up front and a fairly low-res 3-MP camera on the back. By comparison, the Nexus 7 boasts a quad-core Tegra 3 processor, though HP claims that its device offers swift performance.

When we asked HP?s Torres whether shoppers will just opt for the faster Nexus 7 or more family friendly Kindle Fire HD for $30 more, he told us that ?we are going to have a very strong value proposition with Beats Audio and that the design is far superior than those other tablets that you mention.? Torres also reminded us that HP ?wants to be the leader in tablets so to expect other price points.? In other words, don?t be surprised to see a larger, more premium Android Slates in HP?s lineup in the not too distant future.

Parks and Recreation Wedding: 5 Spoilery Bits From Amy Poehler, Adam Scott and Mike Schur

Parks and Recreation Season 5 SpoilersAin?t no party like a Pawnee party ? and the best one is yet to come!

Parks and Recreation is throwing an impromptu wedding for Amy Poehler and Adam Scott?s longtime lovebirds Leslie and Ben in this Thursday?s special installment of the NBC comedy (8:30/7:30c).

?I don?t think anyone will be unsatisfied if you?re looking for a good wedding episode of a television show,? a tight-lipped Scott says of the matrimonial hour. And he?s not the only one singing its praises.

Here, Parks star Poehler, showrunner Mike Schur and Scott himself preview Leslie and Ben?s not-too-rocky road to wedded bliss and reveal what life is like for the duo?beyond?the knot-tying.

NO CALM BEFORE THE STORM | Before Ben and Leslie say ?I do? this Thursday, the latter is going to need a teensy bit of convincing. ?Leslie is a really fun combination of brains and guts,? Schur explains. ?In this case, her brain is operating at [first] and thinking, ?Well, we rented this space and your parents aren?t here and my mom isn?t here.? And then Ben appeals to her gut a little bit and says, ?Doesn?t this just kind feel right? We could get married any time, but doesn?t it feel right to do it tonight, right here right now?? ? and then her gut takes over.? The EP adds that ?a nice scene about reading signs and looking for signs that something is right??also helps Leslie make the choice to move ahead with the speedy nuptials.

GANG?S ALL HERE | It wouldn?t be a Pawnee event without each and every Parks Department member having a task to complete ? and the Knope/Wyatt wedding is no exception. ?There are a lot of details about the wedding, [and] everybody has a job to fill,? Schur teases. ?Part of the fun of the episode is that ? since the wedding was originally planned for May, but at the black-tie gala they decided to do it that night ? they basically have two hours to put it together. So, there?s a part for everybody to play.? The showrunner won?t give out details on each character?s role during the installment, but he does reveal: ?Tom becomes the officiant and has to get ordained online in an hour. And Donna plays a role in that we?re, for the first time, going to feature her beautiful and professionally trained singing voice.?

PRECIOUS MOMENTS | While we have no idea what Poehler is referring to here, the following tease is just too fun not to include. ?There?s a moment in the episode that?s a perfect example of ? in a really beautiful and sweet moment ? just hard laughs. Those sharp turns are so hard to do, and I think Mike does them so well.?

PUT A RING ON IT | Eagle-eyed Parks fans will likely be on the lookout for Ben and Leslie?s coveted gift box during this week?s installment ? you know the one: Ben gave it to Leslie with the ?Knope 2012? pin in it, then she gave it to him with a Washington Monument trinket and then he hid her engagement ring in it? But alas, it looks like the object won?t resurface at the wedding. Explains Schur, ?At one point, [the writers] did think about that box ? which is a very special prop for us ? but we came up with a different delivery mechanism for the wedding rings which I think is extremely satisfying.? To that point, the showrunner advises viewers ?to watch all the way through the episode ? and through the tag that occurs at the very end ? because that tells the story of the rings. It?s kind of a key moment.?

KEEPING IT FRESH | If you?re at all worried that marrying off Leslie and Ben will somehow ruin their dynamic ? or their dynamic with others ? don?t. ?Part of the joy of these two characters and their relationship is that they have very three-dimensional lives,? Schur assures. ?They?re both committed ? not only to each other, but to their careers and their friends and to living a full life.?Maybe there?s a trap you can fall into if you have to tell the story repeatedly about their relationship, but we don?t have that problem.?

In fact, the second installment airing Thursday night (9/8c) aims to ease these concerns altogether. ?The cold open of that episode is Leslie and Ben coming back from their honeymoon and talking about how much fun they had,? he shares, ?but the episode is just a regular episode of Parks and Rec ? Leslie and Ben aren?t in the same story. Ben?s starting a new job and it?s his first day at work, and Leslie has an event she?s planning for a correspondents? dinner? You?ll see right away that there?s a blueprint going forward where yeah, they?re married now, but they also have other aspects of their lives that are very important to them. So, I hope and very much feel like that will be the thing that keeps it from seeming like the ?magic is gone.??

Time to refer Syrian war crimes to ICC, UN inquiry says

GENEVA (Reuters) - United Nations investigators said on Monday that Syrian leaders they had identified as suspected war criminals should face the International Criminal Court (ICC).

The investigators urged the U.N. Security Council to "act urgently to ensure accountability" for violations, including murder and torture, committed by both sides in a conflict that has killed an estimated 70,000 people since a revolt against President Bashar al-Assad began in March, 2011.

"Now really it's time...We have a permanent court, the International Criminal Court, who would be ready to take this case," Carla del Ponte, a former ICC chief prosecutor who joined the U.N. team in September, told a news briefing in Geneva.

The inquiry, led by Brazilian Paulo Pinheiro, is tracing the chain of command to establish criminal responsibility.

"Of course we were able to identify high-level perpetrators," del Ponte said, adding that these were people "in command responsibility...deciding, organizing, planning and aiding and abetting the commission of crimes".

She said it was urgent for the Hague-based war crimes tribunal to take up cases of very high officials, but did not identify them, in line with the inquiry's practice.

Del Ponte, who brought former Yugoslav President Slobodan Milosevic to the ICC on war crimes charges, said the ICC prosecutor would need to deepen the investigation on Syria before an indictment could be prepared.

Pinheiro, noting that the Security Council would have to refer Syria's case to the ICC, said: "We are in very close dialogue with all the five permanent members and with all the members of the Security Council, but we don't have the key that will open the path to cooperation inside the Security Council."

Karen Konig AbuZayd, an American member of the U.N. team, told Reuters it had information pointing to "people who have given instructions and are responsible for government policy, people who are in the leadership of the military, for example".

The inquiry's third list of suspects, building on lists drawn up in the past year, remains secret. It will be entrusted to U.N. High Commissioner for Human Rights, Navi Pillay, upon expiry of its mandate at the end of March, the report said.

Pinheiro said the investigators would not speak publicly about "numbers, names or levels" of suspects, adding that it was vital to pursue accountability for international crimes "to counter the pervasive sense of impunity" in Syria.

FIGHT AGAINST IMPUNITY

The investigators' latest report, covering the six months to mid-January, was based on 445 interviews conducted abroad with victims and witnesses, as they have not been allowed into Syria.

"The ICC is the appropriate institution for the fight against impunity in Syria. As an established, broadly supported structure, it could immediately initiate investigations against authors of serious crimes in Syria," the 131-page report said.

Pillay, a former ICC judge, said on Saturday Assad should be probed for war crimes, and called for outside action on Syria, including possible military intervention.

Government forces have carried out shelling and air strikes across Syria including Aleppo, Damascus, Deraa, Homs and Idlib, the U.N. report said, citing corroborating satellite images.

"In some incidents, such as in the assault on Harak, indiscriminate shelling was followed by ground operations during which government forces perpetrated mass killing," it said, referring to a town in the southern province of Deraa where residents told them that 500 civilians were killed in August.

"Government forces and affiliated militias have committed extra-judicial executions, breaching international human rights law. This conduct also constitutes the war crime of murder. Where murder was committed as part of a widespread or systematic attack against a civilian population, with knowledge of that attack, it is a crime against humanity," the U.N. report said.

Those forces have targeted bakery queues and funeral processions to spread "terror among the civilian population".

"Syrian armed forces have implemented a strategy that uses shelling and sniper fire to kill, maim, wound and terrorize the civilian inhabitants of areas that have fallen under anti-government armed group control," the report said.

Government forces had used cluster bombs, it said, but it found no credible evidence of either side using chemical arms.

Rebels fighting to topple Assad have also committed war crimes including murder, torture, hostage-taking and using children under age 15 in hostilities, the U.N. report said.

"They continue to endanger the civilian population by positioning military objectives inside civilian areas" and rebel snipers had caused "considerable civilian casualties", it said.

"The violations and abuses committed by anti-government armed groups did not, however, reach the intensity and scale of those committed by government forces and affiliated militia."

Foreign fighters, many of them from Libya, Tunisia, Saudi Arabia, Lebanon, Iraq and Egypt, have radicalized the rebels and helped detonate deadly improvised explosive devices, it said.

Report: Senior Iranian official in Lebanon killed

BEIRUT (AP) ? Lebanese media say a senior Iranian official has been killed as he was returning from Syria to Beirut.

Hezbollah-owned Al-Manar TV said Thursday the chairman of the Iranian Council for Reconstruction in Lebanon, Houssam Khosh Nweis, was killed Wednesday by "armed terrorist gangs." The station gave no further details.

Iran is a staunch supporter of Hezbollah and a close ally of Syrian President Bashar Assad.

An Iranian independent news website said Wednesday that a senior commander of Iran's Revolutionary Guard had been killed in Lebanon.

Mashreghnews.ir named the commander as Gen. Hassan Shateri. It said he was the Guard's leader in Lebanon and oversaw Iranian-financed reconstruction projects.

The difference in the name could not immediately be reconciled, but Iranian military officials in Lebanon often work under an assumed name.

This includes rising stock markets, one of the key benefactors of the Federal Reserve?s printing press.

Another not so positive effect (at least not for the American people) are ever increasing prices in the free market, something that Katusa says is going to continue:

When all fiat monetary exchange mechanisms fail, only one asset has stood the test of time as a store of wealth.

Gold is and always has been an insurance policy.

It will be the only thing left standing when the U.S. dollar, the Euro, the Yen, and other paper currencies are inflated to oblivion by their respective governments.

Make sure you have some when that happens.

The Sports Business Journal reports: The NFL is prepared for cold, but contingency plans are being made for how to respond to ominous weather forecasts that might include ice, snow or blizzard conditions when the Super Bowl is played outdoors in the New York area on Feb. 2, 2014.

In the event of a storm the likes of which hit the East Coast last weekend, the NFL could reschedule its billion-dollar extravaganza in the name of safety or switch the date either to the Saturday or the Monday of that weekend.

Government receives insurance dividend

Forsyth County has received a share of a $3.25 million dividend from the board of trustees of the Association County Commissioners of Georgia-Self-Insurance Workers? Compensation Fund.

The dividend of about $1,350 will be returned in the form of a credit toward county workers? compensation premium for the 2013 policy year.

The self-insurance compensation fund is owned by Georgia county government members providing workers? compensation insurance to counties since its inception in 1982.

The fund collectively self-insures a large portion of the risk, which allows county governments to purchase nonprofit insurance coverage at cost-efficient rates typically better than a county could negotiate on its own.

Fred Favors, vice chairman of the board of trustees, said in a statement that the dividend returned to the counties ?rewards those long-term members of [the] workers? compensation fund and can result in a significant reduction in their insurance premium.?

(AP) ? Pau Gasol was diagnosed with a torn plantar fascia in his right foot Wednesday, indefinitely sidelining the 7-foot Spaniard at a key point in the Los Angeles Lakers' belated rally to get in playoff position.

Gasol felt a pop in his foot Tuesday night late in the Lakers' 92-83 victory over the Brooklyn Nets. An MRI in Boston revealed the injury.

The Lakers (23-26) are losing Gasol right when their mostly miserable season is starting to improve with six wins in seven games, including three straight on their longest road trip of the season. Los Angeles also played the last three games without All-Star center Dwight Howard, who has a torn labrum in his right shoulder, and top backup big man Jordan Hill is out for the season with an injured hip.

"I'm hoping to recover asap so I can be back with the team and keep fighting until the end of the season," Gasol tweeted.

Gasol will fly to Los Angeles on Thursday to be examined by team physician Steve Lombardo and foot specialist Kenneth Jung. The Lakers announced they will give a timeline for Gasol's return after the examination, but the injury conceivably could keep Gasol out for several weeks or more if he undergoes surgery to repair the damage.

Gasol has been bothered by tendinitis in both knees and fasciitis for at least two months, hindering his progress since shortly after new coach Mike D'Antoni took over. The four-time All-Star big man also missed five games in January with a concussion, and Gasol largely has been coming off the bench for the Lakers since then.

Gasol is averaging a career-low 13.4 points per game and 8.0 rebounds while playing in just 36 of the Lakers' 49 games.

The Lakers finish their seven-game road trip with three games in four days, starting Thursday in Boston and concluding Sunday in Miami. Rookie center Robert Sacre is available to D'Antoni, and Howard isn't certain when he'll return from an injury that's troublesome, but likely manageable.

Salary cap-strapped Los Angeles could sign a replacement for Gasol after getting a disabled player's exception last week for Hill, who had season-ending hip surgery. But the pool of available free-agent big men is awfully thin, including Lakers retreads such as Troy Murphy and Brian Cook.

(AP) ? Republican Sen. John McCain, a sharp critic of Chuck Hagel's nomination as defense secretary, said Monday he will not support a filibuster of President Barack Obama's pick, even though he declined to say whether he intends to vote for confirmation.

"I do not believe a filibuster is appropriate and I would oppose such a move," McCain told reporters Monday, two days after Senate Republican leader Mitch McConnell raised the possibility.

In the fiercest exchange of Hagel's confirmation hearing last week, McCain questioned the nominee about the Iraq war and whether he was right or wrong in opposing an additional 30,000 U.S. troops in 2007. The Arizona senator said he still has questions on the nomination and "was not happy with his (Hagel's) failure to answer a really simple question."

But McCain insisted he would not support use of the filibuster, a procedural tactic which can derail a confirmation vote and which can be stopped only by the votes of 60 of the 100 senators.

In interview this past weekend, McConnell gave Hagel a poor grade for his testimony before the Senate Armed Services Committee and said opposition to the former Republican senator leading the Pentagon was growing.

"Whether that means he will end up having to achieve 60 votes or 51 is not clear yet," the Kentucky senator, who is seeking re-election, said Saturday at the opening of his campaign headquarters in Louisville.

Hagel seemed ill-prepared under withering cross-examination from committee Republicans in nearly eight hours of testimony last Thursday. He was repeatedly pressed about past statements and votes on Israel, Iran and nuclear weapons, with GOP lawmakers suggesting he wasn't sufficiently supportive of Israel or anti-Iran.

Senate Democrats, who hold the majority, continue to stand behind the nomination, and no Democrat has said he or she would vote against the president's pick for his second-term national security team. Hagel, 66, is a decorated Vietnam combat veteran who served two terms as Nebraska senator.

About a dozen Republican have said they will oppose their former colleague and several others have indicated they are likely to vote no.

Democrats hold a 55-45 advantage in the Senate and two Republicans have announced their support for Hagel ? Sens. Thad Cochran of Mississippi and Mike Johanns of Hagel's home state of Nebraska. Sen. Roy Blunt, R-Mo., a member of the leadership, said he would oppose Hagel, but would not back a filibuster.

McConnell's failure to rule out a filibuster marks the first time the leader has suggested it could be an option. In the past, when Republicans occupied the White House, GOP senators have argued strenuously that nominees should get an up-or-down Senate vote, especially Cabinet picks.

Last Friday, White House spokesman Jay Carney said the administration would be "stunned if, in the end, Republican senators chose to try to block the nomination of a decorated war veteran who was once among their colleagues in the Senate as a Republican."

The White House insisted on Monday that the president stands behind the nominee.

"The issue here is 'how will an individual do the job,' and there's no question in the president's mind that Sen. Hagel will do the job well," Carney said aboard Air Force One.

The Senate Armed Services Committee could vote as early as Thursday on the nomination and refer it to the full Senate. Democrats hold a 14-12 edge on the panel.

PSA: Nexus 4 factory images back online

Almost two months after they were mysteriously pulled from Google's online repository of Nexus factory images, the Nexus 4 stock images have reappeared on the site. These are full copies of the stock Nexus 4 Android 4.2.1 firmware which can be used to reset the device back to factory software if anything goes wrong.

The file's MD5 hash is the same as the earlier image, so it looks like nothing's changed. And obviously, it's the same version of Android running on just about every Nexus 4 at the moment -- Android 4.2.1, build JOP40D. Interestingly, the Nexus 4 hardware binaries required to build AOSP for the device are still missing from the Google Developers site.

In any case, if you want to grab the Nexus 4 factory image you can once again do so at the source link.

On 5th day, officials still mum in Ala. standoff

MIDLAND CITY, Ala. (AP) ? As a police standoff with an Alabama man accused of holding a 5-year-old boy hostage in an underground bunker entered its fifth day, authorities were saying little except that their talks with the 65-year-old loner were continuing through a ventilation pipe.

Negotiators were still trying Saturday to persuade Jimmy Lee Dykes to surrender. Police have said they believe the Vietnam-era veteran fatally shot a school bus driver Tuesday, and then abducted the boy from the bus and disappeared into the home-made bunker.

While police were mostly staying mum about the delicate negotiations, it fell to neighbors to fill in the blanks about Dykes, described by some as a menacing figure with anti-government views.

One of Dykes' next-door neighbors said the suspect spent two or three months constructing the bunker, digging several feet into the ground and then building a structure of lumber and plywood, which he covered with sand and dirt.

Neighbor Michael Creel said Dykes put the plastic pipe underground from the bunker to the end of his driveway so he could hear if anyone drove up to his gate. When Dykes finished the shelter a year or so ago, he invited Creel to see it ? and he did.

"He was bragging about it. He said, 'Come check it out," Creel said.

He said he believes Dykes' goal with the standoff is to publicize his political beliefs.

"I believe he wants to rant and rave about politics and government," Creel said. "He's very concerned about his property. He doesn't want his stuff messed with."

Police have used a ventilation pipe to the bunker to talk to the man and deliver the boy medication for his emotional disorders, but they have not revealed how often they are in touch or what the conversations have been about. Authorities waited until Friday to confirm the suspect's identity.

While much of what is going on inside the bunker remains a mystery, local officials who have spoken to police or the boy's family have described a small room with food, electricity and a TV. And while the boy has his medication, an official also said he has been crying for his parents.

Meanwhile, Midland City residents held out hope that the standoff would end safely and mourned for the slain bus driver and his family. Candlelight vigils have been held nightly at a gazebo in front of City Hall. Residents prayed, sang songs such as "Amazing Grace" and nailed homemade wooden crosses on the gazebo's railings alongside signs that read: "We are praying for you."

"We're doing any little thing that helps show support for him," said 15-year-old Taylor Edwards said.

Former hostage negotiators said authorities must be cautious and patient as long as they are confident that the boy is unharmed. Ex-FBI hostage negotiator Clint Van Zandt advised against any drastic measures such as cutting the electricity or putting sleeping gas inside the bunker because it could agitate Dykes.

The negotiator should try to ease Dykes' anxieties over what will happen when the standoff ends, and refer to both the boy and Dykes by their first names, he said.

"I want to give him a reason to come out," Van Zandt said.

State Rep. Mike Ball of Huntsville, who spent 15 years as a hostage negotiator with the Alabama Bureau of Investigation, said Saturday that the key is patiently building a relationship with Dykes.

"They want to build a relationship with him and calm down the feeling of hopelessness he has," he said. "Any day that goes by with the child alive is a victory. If you string enough of those days together, he will come out."

At a brief news conference Friday to release a photo of Dykes, police brushed off any questions about possible charges.

"It's way too early for that," said Kevin Cook, a spokesman for the Alabama state troopers.

Police have described the bunker as about 4 feet underground, with about 6-by-8 feet of floor space and the PVC pipe that negotiators were speaking through.

State Rep. Steve Clouse, who represents the Midland City area, said he visited the boy's mother and she is "hanging on by a thread." Clouse said the mother told him that the boy has Asperger's syndrome as well as attention deficit hyperactivity disorder, or ADHD.

Dr. Nadine Kaslow, a family therapist and psychiatry professor at Emory University in Atlanta, said the boy's emotional troubles might make things even more difficult for him.

"They have less way to make sense of things," she said of children with Asperger's and ADHD.

The normally quiet red-clay road leading to the bunker was busy Friday with more than a dozen police cars and trucks, a fire truck, a helicopter, officers from multiple agencies and news media near Midland City. The town, population 2,300, is about 100 miles southeast of Montgomery.

Police vehicles have come and gone for hours from the command post, a small church nearby.

Neighbors said Dykes was easily angered and once beat a dog to death with a lead pipe, threatened to shoot children for setting foot on his property and patrolled his yard at night with a flashlight and a firearm.

He was in the Navy from 1964 to 1969, serving some time in Japan, according to military records.

Authorities said Dykes boarded a stopped school bus filled with 21 children on Tuesday afternoon and demanded two boys between 6 and 8 years old. When the driver tried to block his way, the gunman shot him several times and took the 5-year-old boy.

The bus driver, Charles Albert Poland Jr., 66, was hailed by local residents as a hero who gave his life to protect the pupils on his bus.

Dykes had been scheduled to appear in court Wednesday to answer charges he shot at his neighbors in a dispute last month over a speed bump. Neighbor Claudia Davis said he yelled and fired shots at her and her family over damage Dykes claimed their pickup truck did to a makeshift speed bump in the dirt road. No one was hurt.

Creel said his father and Dykes are friends. Creel said that after Dykes' arrest, Dykes wrote a 2- to 3-page letter that at least in part addressed the menacing case.

Michael Creel said he hasn't seen the letter but that his father, Greg Creel, has. Dykes reportedly told the elder Creel he had sent the letter to the local media, politicians and Alabama's governor.

Police on Friday took a copy of the letter from the Creels' home, according to Michael Creel. Reached for comment, Greg Creel confirmed the existence of the letter but declined further comment and said he was cooperating with police.

A neighbor directly across the street, Brock Parrish, said Dykes usually wore overalls and glasses and his posture was hunched-over. He said Dykes usually drove a run-down "creeper" van with some of the windows covered in aluminum foil.

Parrish often saw him digging in his yard, as if he were preparing to lay down a driveway or building foundation. He lived in a small camping trailer and patrolled his lawn at night, walking from corner to corner with a flashlight and a long gun. Authorities have not disclosed what firearms Dykes might have in his possession.
